General Terms of Sale

1. Purpose

These General Terms of Sale (hereinafter "T&Cs") set out the conditions for subscribing to, paying for and using the subscriptions offered by the EYEGOFAST platform, published by Jean-Baptiste Fouroux, a sole proprietorship registered with the Montauban Trade and Companies Register under number 534 481 155.

2. Nature of the Service

EYEGOFAST is a visual-cognitive training application intended for sports and performance purposes. It is not a medical device, a diagnostic tool, an orthoptic rehabilitation solution, nor any form of medical or paramedical treatment. Use of the Platform does not in any way replace consultation with a healthcare professional.

3. Plans and Pricing

The Platform offers the following subscriptions:

In accordance with Article 293 B of the French General Tax Code, VAT is not applicable; prices are therefore shown exclusive of VAT.

4. Obligation of Means

EYEGOFAST is bound by an obligation of means and not of result. The Platform undertakes to provide quality visual-cognitive training tools but does not guarantee any specific result or any real improvement in athletic performance.

Results vary depending on regularity, level, physical and mental condition, environment and the device used.

5. Compatibility, Recommended Devices

EYEGOFAST is designed and optimised exclusively for use on a computer or large tablet. Use on a smartphone is incompatible with the nature of the exercises offered.

EYEGOFAST does not guarantee any performance or result when the Platform is used on a non-recommended device.

6. Subscription and Renewal

Subscriptions are taken out online and renew automatically at each term (monthly or annual), unless cancelled by the user before the renewal date.

The user may cancel their subscription at any time from their personal area. Cancellation takes effect at the end of the current billing period. Access to the service is maintained until the end of the period already paid for.

7. Payment Methods

Payments are processed securely by Stripe, a PCI DSS certified payment provider. EYEGOFAST does not store any banking data.

For organisations or clubs, payments may also be made by bank transfer subject to prior agreement.

8. Refund Policy and Right of Withdrawal

All sales are final. No refunds are granted once the digital service is accessible.

In accordance with Articles L. 221-18 and L. 221-28, 13° of the French Consumer Code, by starting to use the service immediately after purchase, the user expressly waives the 14-day right of withdrawal applicable to digital services within the European Union.

Upon subscribing, the user expressly acknowledges:

• That performance of the service begins immediately after payment is confirmed
• That they waive their 14-day right of withdrawal
• That they have been clearly informed of this waiver before subscribing

9. Changing Plan

The user may switch from one plan to another (Standard → PRO) at any time from their personal area. The change takes effect immediately and the amount is calculated pro rata for the remaining period.

Switching from a higher plan to a lower plan (downgrade) takes effect at the next billing period.

10. Payment Default

In the event of payment failure, EYEGOFAST reserves the right to suspend access to the Platform after a reasonable grace period. The user will be notified by email of any payment failure and will be given time to regularise the situation.

11. Club and Organisation Licences

Club licences are subject to specific conditions set out in the licence agreement. The number of users is limited to the quota defined in the licence. Exceeding the quota may result in additional billing or suspension of the service.

12. Price Changes

EYEGOFAST reserves the right to change its prices at any time. Users with an ongoing subscription will be notified at least 30 days before any new price takes effect. New prices will apply from the next renewal of the subscription.

13. Invoicing

An invoice or receipt is available for each payment via the subscription management portal. Invoices are generated automatically by Stripe.

14. Time to Access the Service

Access to the service is immediate upon payment confirmation. The user receives an email confirmation and may start using the Platform as soon as the subscription is finalised.

15. Limitation of Liability

EYEGOFAST shall under no circumstances be liable for indirect, intangible, commercial or financial damages arising from use of, or inability to use, the service.

EYEGOFAST's total liability is strictly limited to the amount actually paid by the user during the twelve (12) months preceding the dispute.

16. Service Availability

The service is provided "as is" and "as available". EYEGOFAST does not guarantee continuous, uninterrupted or error-free access.

Interruptions may occur, in particular for reasons of maintenance, updates, security or force majeure. No compensation may be claimed on this basis.

17. Service Evolution

EYEGOFAST reserves the right to modify, improve, add or remove at any time all or part of the features, content or services offered, without notice. Such changes do not give rise to any compensation.

18. Consumer Mediation

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, where a dispute cannot be resolved directly with EYEGOFAST, the consumer may use a consumer mediator free of charge.

Before referring the matter to the mediator, the user must have first sent a written complaint to EYEGOFAST via the Contact form.

The mediator may be referred within one year of the written complaint. The European Commission's online dispute resolution platform is available at: https://ec.europa.eu/consumers/odr.

19. Governing Law

These T&Cs are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the French courts, and more specifically the Judicial Court of Montauban, subject to the mandatory legal provisions applicable to consumers.
