Terms of Use

1. Purpose

These General Terms of Use (hereinafter "T&Cs") set out the conditions for accessing and using the EYEGOFAST platform, available at www.eyegofast.com (hereinafter "the Platform"), published by Jean-Baptiste Fouroux, a sole proprietorship registered with the Montauban Trade and Companies Register under number 534 481 155.

Accessing and using the Platform implies full and unreserved acceptance of these T&Cs. If you do not accept these terms, you must not use the Platform.

2. Description of the Service

EYEGOFAST is a SaaS (Software as a Service) digital platform offering visual-cognitive training exercises designed to develop:

• Reaction time
• Attention and concentration
• Visual perception and peripheral vision
• Cognitive processing speed
• Eye–brain coordination

The Platform is intended for athletes, individuals, sports teams, coaches and organisations.

3. Nature of the Service, Important Notice

EYEGOFAST is a visual-cognitive training application intended for sports and performance purposes. It is NOT:

• A medical device
• A diagnostic tool
• An orthoptic rehabilitation solution
• A medical or paramedical treatment

EYEGOFAST does not in any way replace an ophthalmologist, orthoptist or any other healthcare professional. The exercises offered are exclusively cognitive training and sports performance tools. They do not in any way substitute medical advice or healthcare follow-up.

4. Health Notice and Usage Recommendations

The user declares that they are in appropriate physical and mental condition to use the Platform. In the event of any visual, neurological or other condition, the user must consult a qualified healthcare professional before any use.

It is strongly recommended to consult a vision professional (ophthalmologist, orthoptist) before starting visual-cognitive training, in particular in the case of:

• Glaucoma
• Cataract
• Macular degeneration
• Binocular vision disorders
• Amblyopia
• Chronic visual fatigue
• Uncorrected vision
• History of photosensitive epilepsy

The user must immediately stop training in the event of dizziness, eye pain, headaches, discomfort or visual fatigue.

Usage recommendations: The user is encouraged to take regular breaks and to maintain reasonable use of the Platform. Excessive use may reduce training effectiveness and cause fatigue.

EYEGOFAST disclaims all liability for any health consequences arising from unsuitable, excessive or inappropriate use.

5. Compatibility and Recommended Devices

EYEGOFAST is designed and optimised for use on computer and tablet. The effectiveness of visual-cognitive exercises depends directly on screen size and display quality.

Use on a smartphone is strongly discouraged for training exercises. Some features may be limited, unsuitable or offer a non-optimal experience on a small screen.

EYEGOFAST does not guarantee any performance or result when the Platform is used on a non-recommended device, in particular a smartphone.

6. Registration and User Account

Access to the Platform requires the creation of a personal account.

The user undertakes to provide accurate and up-to-date information when registering. They alone are responsible for the confidentiality of their login credentials (email address and password).

Any use of the account is deemed to have been carried out by the account holder. In the event of unauthorised use, the user must inform EYEGOFAST immediately via the Contact form.

7. Minors

Use of the Platform by a minor is permitted only under the responsibility and with the explicit consent of their legal representative (parent or guardian).

The legal representative is entirely responsible for the minor's use of the Platform, for compliance with these T&Cs, and for the suitability of the training with regard to the minor's physical and cognitive abilities.

By creating an account for a minor or authorising its use, the legal representative accepts these T&Cs on their behalf.

8. Prohibition on Account Sharing

Subscriptions are strictly personal, except under an official club licence.

It is strictly prohibited to:

• Share one's account with third parties
• Distribute one's login credentials
• Allow several users to access a single account
• Resell access to the Platform

If account sharing is detected:

• Temporary account suspension
• Permanent account termination
• Cancellation of the subscription without refund

9. SaaS Terms

EYEGOFAST is provided as a service (SaaS). The user is granted a personal, non-exclusive, non-transferable and revocable right of access to the Platform for the duration of their subscription.

This right of access does not confer any ownership over the software, content, algorithms or any other component of the Platform.

10. Intellectual Property

The entire EYEGOFAST Platform, including in particular the exercises, algorithms, content, texts, visuals, concepts, structure, design, trade mark, logos, and any associated technology, is protected by intellectual property law.

Any reproduction, representation, modification, distribution, extraction or exploitation, in whole or in part, without prior written authorisation, is strictly prohibited.

11. Prohibited Uses

It is strictly prohibited to:

• Commercially exploit the Platform without authorisation
• Copy, reproduce or misappropriate the exercises or the system
• Use scripts, bots or automation to access the Platform
• Attempt to access systems or data in an unauthorised manner
• Reverse engineer the Platform
• Extract or index the content in an automated manner
• Impair the integrity or operation of the Platform

Any breach may result in the immediate suspension or deletion of the account, without refund, and give rise to legal proceedings.

12. AI Coach Feature

The Platform includes an automated coaching feature ("AI Coach") that provides recommendations based on the user's training results.

These recommendations are:

• Generated automatically by algorithms
• Intended for training and motivation purposes only
• Not personalised on a clinical or medical level
• Not equivalent to medical, paramedical advice or therapeutic support

The user acknowledges that the AI Coach's recommendations do not in any way substitute the advice of a healthcare professional or a qualified sports coach. The recommendations generated do not constitute automated individual decision-making producing legal or similarly significant effects within the meaning of Article 22 of the GDPR.

13. Club and Coach Licences

The Platform may offer specific licences for sports clubs and coaches. Clubs and coaches act independently and do not represent EYEGOFAST. They are responsible for the use of the Platform by their invited members.

14. Obligation of Means and Limitation of Liability

EYEGOFAST is bound by an obligation of means and not of result. The Platform provides quality visual-cognitive training tools but does not guarantee any specific effect, any real improvement in athletic performance, or any measurable progress.

Results vary depending on:

• Training regularity
• The user's individual abilities
• Sports level
• Physical and mental condition
• Environment and conditions of use
• Device used and screen size

The user uses the Platform at their sole and entire risk.

EYEGOFAST shall under no circumstances be liable for:

• Absence of results or progress
• Incorrect, excessive or unsuitable use
• Any physical or visual discomfort
• Any injury or health consequence
• Any loss of data
• Any indirect, intangible, commercial or financial damage

In any event, EYEGOFAST's total liability is strictly limited to the amount actually paid by the user during the twelve (12) months preceding the event giving rise to the claim.

15. Data and Data Integrity

EYEGOFAST implements reasonable means to ensure the security and integrity of user data.

However, no absolute guarantee is given as to the absence of loss, alteration or unavailability of data. The user is responsible for backing up their information.

16. Service Availability

The service is provided "as is" and "as available". EYEGOFAST does not guarantee continuous, uninterrupted or error-free access.

The service may be suspended, interrupted or limited at any time, in particular for reasons of:

• Maintenance
• Updates
• Technical evolution
• Security
• Force majeure

No compensation may be claimed on this basis.

17. Service Evolution

EYEGOFAST reserves the right to modify, develop, add or remove at any time all or part of the features, content or services offered, without notice. Such changes do not give rise to any compensation.

18. Account Suspension and Deletion

EYEGOFAST reserves the right, at its sole discretion and without notice, to temporarily suspend, limit access to or permanently delete an account, in particular in the event of:

• Non-compliance with these T&Cs
• Abusive or fraudulent use
• Fraud or attempted fraud
• Infringement of intellectual property
• Attempt to copy or reproduce the system
• Unauthorised account sharing
• Conduct undermining the security or reputation of the Platform

No indemnity or refund may be claimed in the event of suspension or deletion due to the user's fault.

19. International Use

The service is available worldwide. The user is responsible for complying with the laws applicable in their country of residence.

20. Governing Law and Jurisdiction

These T&Cs are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the French courts, and more specifically the Judicial Court of Montauban, subject to the mandatory legal provisions applicable to consumers.

21. Changes to the T&Cs

EYEGOFAST reserves the right to modify these T&Cs at any time. Users will be informed of substantial changes. Continued use of the Platform after modification constitutes acceptance of the new terms.
